RENTAL AGREEMENT

RELEASE OF LIABILITY

HOLD HARMLESS AGREEMENT

This Rental Agreement, Assumption of Risk, Release of Liability, Hold Harmless Agreement, and Indemnification Agreement ("Agreement") is entered into between Winni Jet Ski Rentals ("Company") and the undersigned participant ("Renter"), individually and on behalf of all passengers accompanying the Renter. By signing below, the Renter acknowledges that they have carefully read this entire Agreement, understand its contents, and voluntarily agree to all terms. I have read over the company policies and accept.

1. ACKNOWLEDGEMENT OF INHERENT RISKS

I understand that operating or riding a personal watercraft (PWC), commonly known as a Jet Ski, involves known and unknown dangers, including but not limited to: Collision with boats, docks, swimmers, rocks, buoys, shorelines, floating debris, wildlife, or submerged objects. Capsizing. Falling from the watercraft. Drowning. Hypothermia. Changing weather conditions. High winds. Rough water. Mechanical failure. Equipment malfunction. Operator error. Passenger error. Negligence of other boaters. Waves from other vessels. Exposure to fuel. Slips and falls. Physical injury. Permanent disability. Paralysis. Emotional distress. Property damage. Death. Sun poisioning. Dehydration. Muscle fatigue. Stiff neck. Sore muscles. Bumpy driving. Difficult to drive. Hard to steer. No brakes. Harsh sunlight. Extremely hot weather. Extremly cold water. Possibility of drowning. Possibility of swimming to shore. Possibility of flipping the jet ski. Having to roll jet ski back over after flipping. Losing the key in the middle of the lake and being stranded. Rocks underwater. Running out of gas.

2. ASSUMPTION OF ALL RISKS

I voluntarily choose to participate despite these risks. I knowingly and freely assume every risk, whether known or unknown, foreseeable or unforeseeable. I accept full responsibility for every injury, illness, disability, death, property loss, or financial loss that may occur during: Instruction. Launching. Riding. Docking. Returning. Loading. Unloading. Transportation. Any activity connected with this rental.

3. RELEASE OF LIABILITY

To the fullest extent permitted by law, I release and forever discharge:

Winni Jet Ski Rentals, its owners, employees, independent contractors, agents, volunteers, affiliates, successors, assigns, property owners, marinas, launch facilities, equipment manufacturers, and all persons acting on their behalf, from any and all claims, lawsuits, causes of action, liabilities, damages, judgments, costs, attorney fees, expenses, or demands arising out of or relating to my participation. This release applies whether the claim is based upon negligence, premises liability, product liability, breach of contract, or any other legal theory, except where prohibited by law.

4. HOLD HARMLESS & INDEMNIFICATION

I agree to defend, indemnify, and hold harmless Winni Jet Ski Rentals from every claim made by: Me. My spouse. My children. My heirs. My estate. Family members. Guests. Passengers. Insurance companies. Anyone acting on my behalf. If a lawsuit is filed arising from my participation, I agree to reimburse Winni Jet Ski Rentals for all attorney fees, court costs, expert witness fees, investigation costs, settlements, and judgments to the extent permitted by law.

5. DAMAGE RESPONSIBILITY

I accept complete financial responsibility for damage to: Jet Ski. Property. Other boats. Vehcles. Buildings. Docks. Or any third-party property damagede while the equipment is in my possession. Normal wear excluded.

6. PERSONAL RESPONSIBILITY

I understand I am personally responsible for: Operating safely. Following boating laws. Following New Hampshire regulations. Watching for other vessels. Maintaining safe speed. Keeping proper lookout. Avoiding reckless behavior. Maintaining safe distance from shore and swimmers. My saftey. My passangers safety. The saftey of others in the water. Wearing a proper life jacket. Knowing how to operate a jet ski. Having a boating license.

I acknowledge receiving instruction regarding: Starting. Stopping. Emergency shutoff. Engine cutoff lanyard. Idle speed. No Wake Zones. Navigation rules. Emergency procedures. Returning to dock. Fuel. Passenger safety. Reboarding after falling off. Emergency contact procedures.

9. OPERATIONAL RULES

I agree that I will NOT: Race. Jump wakes. Operate recklessly. Tow people. Operate after consuming alcohol. Allow unauthorized operators. Exceed passenger limits. Operate after dark. Operate during unsafe weather. Remove safety equipment. Tamper with GPS or tracking equipment. Use the Jet Ski for illegal activity.

10. WEATHER

I understand weather conditions may change rapidly. I accept all risks associated with weather. The Company may terminate my rental at any time if conditions become unsafe.

11. MECHANICAL FAILURE

I understand mechanical equipment can fail without warning. I assume all risks arising from equipment failure.

12. MEDICAL AUTHORIZATION

If injured, I authorize emergency medical treatment. I accept all costs associated with emergency care.

13. PHOTOGRAPHY

I grant permission for photographs or videos taken during the rental to be used for promotional purposes without compensation.

14. GOVERNING LAW

This Agreement shall be governed by the laws of the State of New Hampshire. Any dispute shall be brought exclusively in a court of competent jurisdiction located in New Hampshire unless otherwise required by applicable law.

15. SEVERAILITY

If any provision is found unenforceable, all remaining provisions shall remain in full force and effect.

16. ENTIRE AGREEMENT

This document represents the entire agreement between the parties. No verbal statement changes this Agreement.

17. ACKNOWLEDGEMENT

I HAVE CAREFULLY READ THIS ENTIRE AGREEMENT.

I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS.

I SIGN THIS DOCUMENT FREELY AND VOLUNTARILY.

I UNDERSTAND THAT THIS IS A RELEASE OF LIABILITY AND ASSUMPTION OF RISK. I UNDERSTAND THAT JET SKIING IS VERY DANGEROUS, HARD ON THE BODY, AND EXTREMELY DIFFICULT.
